The Collaborative Law Process
How does the process work? To begin, each party must be represented by an attorney trained in collaborative law. The parties must also sign a participation agreement, which requires honest disclosure, a promise not to go to court, and good faith efforts to resolve the case, among other things. What happens next is usually a series of four-way meetings (each spouse and their lawyer in attendance) where solutions to divorce-related issues, such as child custody or support, can be worked out between the parties.
The Pro's and Con's of Using the Collaborative Law Approach
The only real drawback to the collaborative law approach is that if the process fails, you must hire a different attorney or law firm to represent you in litigation. However, this also helps to keep the parties invested in the process. But the benefits are numerous. One of the main benefits is that children are not forced to deal with the damaging effects of bitter litigation. Collaborative law also enables you and your spouse to preserve or rebuild a relationship, set the agenda and pace of the process, keep matters as confidential as possible, and may save you a great deal of time and expense as well.
