Construction Defects

Construction defects are a major cause of construction litigation. If a construction-related material defect exists, the first choice of many contractors and subcontractors will be to fix or "cure" it. This does not necessarily mean the ability to "cure" the defect in a strict legal sense in all situations. To be sure, it may be a possible and desirable solution to the problem in certain circumstances. The decision, however, is not always up to the builder or contractors. Even with new homes and homes that have undergone a substantial remodel, owners do not have to accept offers to cure defects in their home's construction and may instead pursue other legal remedies, including litigation.

Arbitrated Results

Many construction-related contracts contain clauses that require arbitration in the event of a dispute. When this is the case, our firm is well positioned to attend to your needs just as effectively. All lawyers in our office have extensive arbitration experience and are prepared to serve as counsel to parties in the arbitration process.
