About Post-Divorce Modification

Generally speaking, individuals can obtain a modification to divorce terms involving custody, support and visitation whenever significant changes have occurred in their lives. In some situations such as with a short-term illness, the modification may be very temporary in nature. In others, as with a long-term disability or relocation, it may be more permanent. Whatever the situation, the process begins by filing a petition with the court to modify an existing order for custody, visitation or support on the basis of changed needs or circumstances. Extending Child Support

In Washington State, support can be obtained for children up to the age of 23 if they are dependent and in college. In many divorces, this situation is not taken into account for purposes of child support. The problem is that children in today's society stay at home much longer, often well into their 20's. If a modification is not sought and obtained before support under the original divorce order ends, the parent with primary residential custody may be forced to absorb that financial responsibility alone.
