Relocation for Custodial and Non-Custodial Parents

Relocation by one or both spouses is not uncommon after divorce. However, it may require major changes to the parenting plan. Instead of spending time with a child or children on a weekly or bi-weekly basis, mom or dad may have to live without physical contact with their child (or children) for months at a time. For this reason, many relocation cases are contested.

Our firm protects the interests of spouses on both sides of this issue. We advise custodial parents who want to move and make certain that the proper steps are followed. We also represent non-custodial parents who are moving but who want to make certain they can maintain a meaningful relationship with their children. Challenging Parental Relocation

In addition to pursuing modifications for a moving parent, our attorneys represent parents challenging a relocation (move-away) as well. Custodial parent relocation requires that proper notice of the proposed change be given to the non-custodial parent. Once notified, that parent has 30 days in which to file a challenge with the court. If you have received a relocation notice or a request for modification — remember that time is limited and that the sooner you at least talk to an attorney about how your rights might be affected the better your chances will be to protect them.
